{"id":4854,"date":"2014-05-22T10:45:09","date_gmt":"2014-05-22T10:45:09","guid":{"rendered":"http:\/\/www.ihrda.org\/?p=4854"},"modified":"2014-05-27T12:45:39","modified_gmt":"2014-05-27T12:45:39","slug":"30505-article-19-et-autres-zimbabwe","status":"publish","type":"post","link":"https:\/\/www.ihrda.org\/fr\/2014\/05\/30505-article-19-et-autres-zimbabwe\/","title":{"rendered":"305\/05 : Article 19 et autres \/ Zimbabwe"},"content":{"rendered":"<p><strong><em>R\u00e9sum\u00e9 des faits<\/em><\/strong><\/p>\n<p>L\u2019IHRDA, le Media Institute of Southern Africa (MISA, Zimbabwe) et Article 19 ont d\u00e9pos\u00e9 cette communication \u00e0 la Commission Africaine des droits de l\u2019homme de la part de Capital Radio PrivateLimited (CRPL), une entreprise de radiodiffusion ind\u00e9pendante au Zimbabwe. Les requ\u00e9rants pr\u00e9tendaient que les r\u00e9gulations sur la radiodiffusion au Zimbabwe limitait excessivement leur libert\u00e9 d\u2019expression. L\u2019Act of BroadcastingAuthority of Zimbabwe imposait aux radios des frais exorbitants lors de l\u2019application pour une licence de diffusion. M\u00eame si les frais \u00e9taient pay\u00e9s, la licence \u00e9tait refus\u00e9e.<\/p>\n<p>Le ministre de l\u2019information d\u00e9clara publiquement qu\u2019il ne serait jamais octroy\u00e9 \u00e0 Capital Radio de licence \u00e0 cause du fait que ses propri\u00e9taires \u00e9taient majoritairement blancs. Par la suite, la police a confisqu\u00e9 l\u2019\u00e9quipement de la station.<\/p>\n<p>Cette affaire a \u00e9t\u00e9 port\u00e9e devant la Cour Supr\u00eame du Zimbabwe, sans que les requ\u00e9rants puissent obtenir satisfaction.<\/p>\n<p><strong><em>Violations pr\u00e9tendues de la Charte africaine des droits de l\u2019homme et des peuples <\/em><\/strong><\/p>\n<p>Article 1 &#8211; Obligation des Etats parties<\/p>\n<p>Article 2 &#8211; Droit \u00e0 la non-discrimination<\/p>\n<p>Article 9 &#8211; Droit \u00e0 la libert\u00e9 d&rsquo;expression<\/p>\n<p><strong><em>Etat de la communication\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/em><\/strong><\/p>\n<p>La Commission ne s\u2019est pas prononc\u00e9e sur le fond de cette communication, car elle fut d\u00e9clar\u00e9e non recevable lors de sa 48<sup>\u00e8me<\/sup> Session ordinaire tenue \u00e0 Banjul, Gambie, du 10 au 24 novembre 2010.
